These Terms and conditions apply to this website and to the transactions related to our products and services. You may be bound by additional contracts related to your relationship with us or any products or services that you receive from us. The mere use of this website implies the knowledge and acceptance of these Terms and conditions. In some particular cases, we can also ask you to explicitly agree.

11. Export restrictions / Legal compliance
Access to the website from territories or countries where the Content or purchase of the products or Services sold on the website is illegal is prohibited. You may not use this website in violation of export laws and regulations of United Kingdom.

Without prejudice to our other rights under these Terms and Conditions, if you breach these Terms and Conditions in any way, we may take such action as we deem appropriate to deal with the breach, including temporarily or permanently suspending your access to the website, contacting your internet service provider to request that they block your access to the website, and/or commence legal action against you.
14. Indemnification
You agree to indemnify, defend and hold us harmless, from and against any and all claims, liabilities, damages, losses and expenses, relating to your violation of these Terms and conditions, and applicable laws, including intellectual property rights and privacy rights. You will promptly reimburse us for our damages, losses, costs and expenses relating to or arising out of such claims.
15. Waiver
Failure to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision.
16. Language
These Terms and Conditions will be interpreted and construed exclusively in English. All notices and correspondence will be written exclusively in that language.
17. Entire agreement
These Terms and Conditions, together with our privacy statement and cookie policy, constitute the entire agreement between you and Livia Boiciuc in relation to your use of this website.
18. Updating of these Terms and conditions
We may update these Terms and Conditions from time to time. It is your obligation to periodically check these Terms and Conditions for changes or updates. The date provided at the beginning of these Terms and Conditions is the latest revision date. Changes to these Terms and Conditions will become effective upon such changes being posted to this website. Your continued use of this website following the posting of changes or updates will be considered notice of your acceptance to abide by and be bound by these Terms and Conditions.
19. Choice of Law and Jurisdiction
These Terms and Conditions shall be governed by the laws of United Kingdom. Any disputes relating to these Terms and Conditions shall be subject to the jurisdiction of the courts of United Kingdom. If any part or provision of these Terms and Conditions is found by a court or other authority to be invalid and/or unenforceable under applicable law, such part or provision will be modified, deleted and/or enforced to the maximum extent permissible so as to give effect to the intent of these Terms and Conditions. The other provisions will not be affected.
20. Application form notice
Agreement between Artist and LISU (LISU HUB).
DEFINITIONS
For the purposes of this Agreement, the following terms shall have the meanings set forth below:
1.1 ”Artwork”– Refers to the work(s) of art, including paintings, sculptures, photographs, digital art, mixed media, installations, and any other visual art form submitted by the Artist for consideration for inclusion in the Exhibition. Each individual piece of art shall be considered a separate “Artwork.”
1.2 “Exhibition Fee”– Refers to the non-refundable fee of £45 (Forty-Five British Pounds) that the Artist is required to pay to the LISU upon submitting the application for consideration to participate in the Exhibition.
1.3 “Selection Process”– The procedure by which the Company will review applications and determine which artists and artworks will be included in the Exhibition.
1.4 “Promotional Materials”– Includes any images, biographies, artist statements, videos, or other materials submitted by the Artist to the LISU for the purpose of marketing and promoting the Exhibition and the Artist’s participation.
1.5”Event”– Refers to the time period during which the Exhibition is open to the public, from the installation date to the removal of Artwork from the Venue.
2. APPLICATION AND SELECTION PROCESS
2.1 Application Submission
The Artist agrees to submit an online application via the LISU’s website along with the following materials:
– A completed application form provided by LISU.
– A non-refundable Exhibition Fee of £45 (Forty-Five British Pounds), payable via PayPal or Debit Card.
– At least one high-resolution images of the proposed Artwork(s), each labeled with the title, medium, dimensions, and year of creation.
– An artist biography (maximum of 300 words), a brief artist statement (maximum of 300 words), and any other materials that LISU deems relevant for evaluation.
– Links to any online portfolio or social media accounts (optional but encouraged).
2.2 Deadline for Application
The Artist agrees to submit their application and required materials before the submission deadline. Applications submitted after the deadline may be disregarded, at the sole discretion of LISU.
Addition, LISU will notify you about any potential changes 7 days in advance.
2.3 Exhibition Fee
The Exhibition Fee is a non-refundable fee required for processing the Artist’s application.
In case of not approving of the artist’s art work(s) for physical exhibition, LISU gives the alternative to share and promote their art works via LISU (including all social medias and private channels).
2.4 Selection Criteria
The selection of artworks will be based on several factors, including but not limited to:
– Artistic merit and quality of the work.
– Originality and creativity of the submission.
– Suitability of the Artwork to the overall theme of the Exhibition.
– Technical proficiency and professional presentation of the Artwork.
– The Artist’s ability to engage with the audience through their work and/or artistic statement.
– Commercial potential and marketability of the artwork, at the discretion of LISU.
2.5 Notification of Acceptance
LISU will notify the Artist of their acceptance or alternative for the Exhibition no later than specified date. LISU’s decision is final and binding, and no reasons will be provided.
3. Content Creation and Submission
The Artist agrees to submit all requested Promotional Materials, including but not limited to:
– High-quality digital images of the Artwork(s) to be featured in the Exhibition.
– A short video or behind-the-scenes content, if applicable.
– Artist biography and statement.
– Any other requested content that will assist in the promotion of the Artist and their work.
3.1 Rights to Use Content
The Artist hereby grants LISU a non-exclusive, irrevocable, royalty-free license to use, reproduce, distribute, and display the Artwork(s), Artist’s name, image, and biography for the purpose of promoting the Exhibition and future events, both during and after the Exhibition. This license includes, but is not limited to, social media posts, websites, advertisements, and press releases. LISU may edit, crop, or adjust content to suit its promotional needs.
4. ARTWORK SUBMISSION, INSTALLATION, AND DISPLAY
4.1 Submission of Artwork
The Artist agrees to submit their accepted Artwork(s) to the Venue by the designated date, which shall be no later than specified date. The Artist is responsible for delivering their Artwork(s) to the Venue and must ensure that the Artwork is in the appropriate condition for display (e.g., framed, properly packed, etc.). The Artist will bear all costs associated with the delivery of the Artwork to and from the Venue. Simply, the artist he/she is responsible for: packing and shipping charges, customs/vat/ duty taxes, insurance costs, other handling expenses, collection and risk of loss or damage incurred in the delivery of Artworks from the Artist to LISU and back to the Artist.
4.2 Preparation and Display
The Artist agrees to ensure that their Artwork is properly prepared for display, including appropriate framing, hanging hardware, or any other necessary preparations. LISU reserves the right to reject any Artwork that does not meet the standards required for display in the Exhibition.
4.3 Display Rights and Restrictions
LISU shall have the exclusive right to determine the placement and display of the Artwork within the Venue. The Artist agrees to accept the LISU’s final decision regarding the arrangement of the Exhibition, which may be influenced by factors such as space constraints, thematic considerations, and technical requirements.
4.5 Installation and Deinstallation
LISU will provide a designated time period for the installation and deinstallation of Artwork. The Artist agrees to adhere to the scheduled installation and removal dates as provided by LISU. If the Artist fails to retrieve their Artwork by the designated removal date, LISU may, at its sole discretion, dispose of the Artwork without compensation to the Artist.
5. SALES, COMMISSION, AND PAYMENT TERMS
5.1 Sales Commission
LISU does not take sales commission of artworks which are nominated for physical exhibitions.
5.2 Payment to Artist
The Artist will be directly paid for any Artwork sold by LISU.
